California Elder Abuse Attorney Talks about Who Is Caring for Our Elderly

California Elder Abuse Attorney Talks about Who Is Caring for Our Elderly
Tuesday, June 8, 2010 by Emery B. Ledger
The United States population is aging at a rapid pace. The government is worried about how they are going to provide Social Security to the millions of Americans that become eligible to receive it every year. Companies have cut back on pensions because people are living longer and they can’t afford to pay them. Census date tells us that the percentage of people living in the United States over the age of 65 is three times higher than it was a century ago. That should be good news for those of us that haven’t reached our twilight years yet. With advances in medicine and better quality of life, we should be able to look forward to living longer and better lived. Unfortunately, that may depend on who is taking care of us when we get there.

New York Criminal Defense: Tips on Jury Selection For Defense Attorneys

Tips on Jury Selection For Defense Attorneys
These suggestions were passed on to me by an excellent, experienced attorney who wishes to remain anonymous:

1. In jury selection you will be engaging in several efforts at once -picking the jurors who are best for your case, educating the jury, developing your challenges for cause, figuring out who these people are, and letting the jury know you are way cooler than the DA. On challenges for cause, when you develop them the judge may swoop in and try to rehabilitate the juror by asking, "You will follow my instructions, won't you?" in some menacing fashion from on high, black robe billowing. If this happens during your voir dire, you can may still be able to ask the juror afterwards about his or her original concerns, and revive the challenge. If a juror says "I think I can be fair" or answers the judge's questions (or yours or the DA's) in an equivocal way that's not enough to avoid the challenge for cause. (People v Arnold [96 NY2d 358, 363]). Make sure that your challenge is on the record - in case the judge incorrectly denies the challenge.

What the future holds for second DUI offenders and their license in CA
Saturday, June 5, 2010 by Matthew J. Ruff
Last year the california legislature enacted the assembly bill that would allow a second time DUI offender to get a restricted license after only a 90 day suspension, this marks a huge departure from the normal suspension that is one year according to a Seal Beach DUI Attorney . The new law effectively reduces the period of mandatory suspension on a second DUI from two years to 90 days and the DMV will have to give the CDL back or face a violation of the law. But how does the suspension relate to the APS order that may have also been imposed? That is the question many DUI lawyers are asking but answers are not forthcoming.
